THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY Contempt Case No.2616 of 2017 ORDER:

This Contempt Case is filed alleging violation of orders dated 07.03.2014 passed by this Court in W.P.No.13243 of 2005 by respondent.

By the above said order, this Court has directed respondent Nos.1 and 2 therein to resort to the legal proceedings if they want to acquire the land of the petitioners therein and till then, the possession of the petitioners therein shall not be disturbed. Learned Senior Counsel appearing for the petitioner submitted that the respondent Municipal Corporation has forcibly occupied the petitioner's land and constructed she toilets in the subject property claimed by the petitioner.

During the pendency of the contempt case, counter affidavit has been filed by respondent disputing the ownership of the petitioner and stating that she toilets are constructed in the Municipal area. Since there is dispute with regard to identification of the subject property, it is left open to the petitioner to initiate appropriate proceedings claiming their land, if it is occupied by the Municipal Corporation in accordance with law.

This contempt case accordingly closed.

Miscellaneous petitions, if any pending in this contempt case shall stand closed.
