THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.43516 of 2017 When the matter is taken up, written instructions, dated 21.12.2017, furnished by the Sub-Inspector of Police, Amalapuram Town Police Station, East Godavari District, are placed on record. The said instructions read as under: "It is submitted that the Station House Officer, Amalapuram Town Police Station, East Godavari District received the petitioner's complaint dated 11.11.2017 through registered post, wherein he stated that his marriage was performed on 26.11.2005 with the 5th respondent Kudupudi Leela Kumari and during the wedlock two male children was born to them. Thereon the 6th respondent Vasarla Satya Srinivas developed illegal intimacy with the 5th respondent and in the month of July, 2017 the respondent No.5 eloped with the 6th respondent along with the petitioner's younger son Devisri Vijaya Satya Kumar.

The Amalapuram police has registered a case in Cr.NO.230/2017 for the offences Under Head women missing and the 5th respondent admitted her adultery before the police in Cr.No.230/2017. Thereon, the respondents 5 and 6 continued their illegal contract. The respondents 5 and 6 tried to kill the petitioner and kidnap two children of the petitioner. The petitioner requested the police to take necessary action. It is submitted that as the petitioner sent his complaint dated 11.11.2017 through registered post, after conducting preliminary enquiry, a case was registered in Cr.No.423/2017 dated 16.11.2017 for the offences U/s 497 IPC and Section 365 r/w 511 r/w 34 IPC against the respondents 5 and 6 Kudupudi

Leela Kumari and Vasarla Satya Srinivas on the file of Amalapuram Town Police Station, East Godavari District and investigation has been taken up. During the course of investigation as many as (46) forty six witnesses have been examined and recorded their detailed statements. The respondents 5 and 6 A1 and A2 are absconding. However sincere efforts are being continued to apprehend them. After completion of investigation, an appropriate report will be filed before the concerned Court.

It is further submitted that in Cr.No.230/2017 for the offences Under Head women missing, the investigating officer handed over the 5th respondent to her parents and final report as 'action drop' filed on 12.09.2017 before the Mandal Executive Magistrate, Amalapuram, East Godavari District.

It is further submitted that earlier the petitioner herein also filed W.P.No.38811/2017 with similar prayer to direct the police to take necessary action against the respondents 5 and 6 pursuant to the complaints dated 19.08.2017, 08.11.2017 and 11.11.2017".

In view of the registration of the crime, as stated supra in the written instructions, the Writ Petition is disposed of, by placing on record the above written instructions. As a sequel thereto, miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ________________ A.V.SESHA SAI 22nd January, 2018.
