HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.39893 OF 2017 ORDER:

This writ petition is filed challenging the impugned proceedings dated 20-11-2017, wherein the petitioner was directed to remove the structures constructed in the Grampanchayat premises without any permission from the Grampanchayat.

Sri C.Nageshwar Rao, learned Senior Counsel for the petitioner submits that the 4th respondent has no jurisdiction to issue such notice as per the rules. The same is not disputed by Sri G.Seshadri, learned Standing Counsel, who however submits that people of the village wanted a shed to be constructed for the purpose of waiting to receive the pensions, as the Grampanchayat premises is not sufficient, the petitioner has come forward for construction of the shed. If the petitioner agrees that the said shed forms part of Grampanchayat property, the respondents have no objection for construction of the same treating it as Grampanchayat property. Learned Senior Counsel submits that the petitioner is constructing shed for the purpose of Grampanchayat and the petitioner will not claim any personal rights in the shed to be constructed by the petitioner at his own costs and the same will form part of Grampanchayat property.

Recording the submissions of learned Senior Counsel, the impugned proceedings are set aside and accordingly, the writ petition is allowed. However, the shed will form part of

Grampanchayat property and the petitioner will not claim any rights in the said structures. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
