M.R. Satish Kumar, v. The State Of Telangana,
THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO WRI T PETI TI ON No.39883 of 2017 ORDER:
The petitioner is working as Work Inspector on contract basis in the second respondent Corporation in Engineering Wing since 1999. He was entrusted with electrical work, carpentry work, plumber work and other works. He is one of the employees who filed a writ petition for payment of salaries on par with the regular employees.
2.
It is the case of the petitioner that when he and other employees brought to the notice of the higher authorities, including the first respondent, with regard to the misappropriation of funds by the officers of the second respondent Corporation, the second respondent Corporation passed an order on 16.11.2017, transferring him from Hyderabad to Elagandla Fort, Karimnagar District. Immediately, the petitioner made a representation on 18.11.2017 to the second respondent Corporation requesting for postponement of his transfer till the completion of the current academic year for the sake of education of his children. As no action has been taken by the second respondent Corporation on the said representation, the petitioner filed the present Writ Petition.
3.
The learned counsel for the petitioner submits that the petitioner is having three children viz., two daughters and a son and they are studying degree, polytechnic and 8th class respectively; that the petitioner's son met with an accident on 16.11.2017 and his leg was fractured; that the petitioner's second daughter, who suffered from hernia, undergone a surgery recently i.e., in the month of September, 2017; that with great difficulty, the petitioner is maintaining the family with the meager salary and that by the impugned order, if the petitioner is transferred to a distance of 200 KM from Hyderabad, where he is presently working, that too in the middle of the academic year, it would result in hardship to him and his family. The learned
ARLR,J W.P.No.39883 of 2017 04.12.2017 counsel further submits that as the above factors are not considered by the second respondent Corporation while transferring the petitioner by the impugned order, the petitioner filed representation, dated 18.11.2017, before the said respondent, which is pending for consideration. 4.
In the above facts and circumstances of the case, since the petitioner's representation, dated 18.11.2017, is pending before the second respondent Corporation, the said respondent is directed to consider the same and pass appropriate orders thereon within a period of three weeks from the date of receipt of a copy of this order.
5.
Subject to the above direction, the Writ Petition is disposed of. 6.
As a sequel to disposal of the writ petition, W.P.M.P.No.49445 of 2017 filed by the petitioner for interim relief shall stand disposed of as infructuous. __________________________________ A.RAMALI NGESWARA RAO, J 04th December, 2017 Note: Dispatch copy by Friday i.e., 08.12.2017. (B/o) GHN
