THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL REVISION PETITION No.6608 of 2017 ORDER:

This Civil Revision Petition is filed under Article 227 of the Constitution of India challenging the inaction on the part of the learned Senior Civil Judge, Rayachoty, YSR Kadapa District, in disposing of I.A.No.538 of 2015 in O.S.No.78 of 2015. 2.

Heard learned counsel for the petitioners and perused the record.

A perusal of the record reveals that the respondent filed O.S.No.78 of 2015 on the file of the Court of Senior Civil Judge, Rayachoty, against the petitioners seeking permanent injunction. He also filed I.A.No.538 of 2015 in O.S.No.78 of 2015 under Order XXXIX Rules 1 and 2 CPC seeking ad interim injunction. The trial Court granted ex parte interim injunction in favour of the respondent. The petitioners filed counter in I.A.No.538 of 2015 to vacate the order of interim injunction. For one reason or the other, the trial Court has not disposed of I.A.No.538 of 2015. 4.

The only relief sought by the learned counsel for the petitioners is to direct the learned Senior Civil Judge, Rayachoty, to dispose of I.A.No.538 of 2015 in O.S.No.78 of 2015 as expeditiously as possible, on merits.

In view of the submissions of the learned counsel for the petitioners, this Civil Revision Petition is allowed with a direction to the learned Senior Civil Judge, Rayachoty, to dispose of I.A.No.538 of 2015 in O.S.No.78 of 2015, as expeditiously as possible, preferably, within a period of one month from the date of receipt of a copy of this order.

Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
