THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.43232 of 2017 ORDER:

The petitioner joined the service of the District Cooperative Central Bank as Driver on 03.03.1985 and is presently working in the District Co-operative Central Bank, Srikakulam Branch. Now when a notice was issued on 27.11.2017 indicating that he would be retiring by 31.12.2017 after attaining the age of 60 years, the present Writ Petition is filed.

Learned Counsel for the petitioner submits that the age of retirement of all employees was enhanced from 58 to 60 years, but the retirement age of the Class IV employees was not enhanced though the age of retirement was 60 years prior to enhancement. He further submits that the petitioner submitted a representation on 11.12.2017 and the same shall be considered.

As could be seen from the provisions of Act 4 of 2014 the age of retirement of the employees who were retiring at 58 years was enhanced to 60 years and the age of retirement of other employees who were retiring at 60 years is not enhanced. Thus, as on today there is no rule providing for retirement at the age of 62 years. In the absence of any rule, this Court cannot issue a direction to consider the representation submitted by the petitioner on 11.12.2017. This Court noticed that the letter

issued on 27.11.2017 indicating that the petitioner is going to retire on 31.12.2017 on attaining the age of superannuation is proper and sees no ground to entertain the present Writ Petition.

The Writ Petition is, accordingly, dismissed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 19.12.2017 vs
