Petition filed under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to enlarge the petitioner on bail in COR.No. 67 of 2017, dt.27-10-2017 on the file of Prohibition and Excise Station, Utnoor, Adilabad District. The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri Lakkadi Dayaker Reddy, Advocate for the Petitioner and of Public Prosecutor(AP) on behalf of Respondent-State, the Court made the following ORDER :- "This Criminal Petition is filed by the petitioner/Accused under section 437 and 439 of Cr.P.C., seeking to enlarge him on bail in Crime/COR.No. 67 of 2017 of Prohibition and Excise Police Station, Utnoor, Adilabad district, registered for the offences punishable under section 8 [b] read with section 20 [a] of Narcotic Drugs and Psychotropic Substances Act, 1985.

2. Heard the learned counsel for the petitioner/accused and the learned Public Prosecutor for the respondent/State.

3. As per the case of prosecution, the petitioner was found cultivating 15 cannabis [ganja] plants in survey No. 214 and the same were seized. Except FSL report, the entire investigation is completed. Hence, considering the nature of the offence and the quantity of ganja plants seized from the land of the petitioner, and the fact that the petitioner is in jail since 27/10/2017, this Criminal Petition is allowed.

5. Accordingly, the petitioner/accused shall be released on bail in Crime/COR.No. 67 of 2017 of Prohibition and Excise Police Station, Utnoor, Adilabad district, on his executing a personal bond of Rs.10,000=00 (Rs. Ten Thousand only) with two sureties for the like sum each to the satisfaction of Judicial Magistrate of First Class, Utnoor, Adilabad district.

6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed."
