M/S Varuna Hatcheries Pvt. Ltd. v. The Mandal Survey Officer

THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.42479 OF 2017 ORDER:

This writ petition is filed challenging the notice issued by the first respondent on 08.12.2017 proposing to conduct survey on 13.12.2017 in respect of the land in Survey No.4 situated at Kothaguda Village of Serilingampally Mandal, Ranga Reddy District. The petitioner raised objections for such survey and filed the present writ petition. This Court granted interim stay on 13.12.2017 for a period of two weeks and it is extended upto 25.01.2018.

Now when the matter is taken up for consideration, the learned Government Pleader, on the basis of the written instructions, submits that the first respondent, Mandal Surveyor, was not aware of the pendency of the civil suit before the Civil Court, but on receipt of the objections filed by the petitioner herein, the proposed demarcation of the land was cancelled and further action was dropped. It is categorically stated that no survey has been conducted on the land.

In view of the statement made by the learned Government Pleader, based on the written instructions issued by the first respondent, Mandal Surveyor, no further orders are necessary in the writ petition. The writ petition is accordingly closed. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
