AMARNATH GOUD FCA.No. 498 OF 2017 J U D G M E N T : [ O R A L ] [ Per the Hon'ble Sri Justice Suresh Kumar Kait ] Vide the present appeal, the appellant has challenged the order dated 12/09/2017 passed in FCOP.No. 270 of 2015 by the Family Court, Hyderabad, whereby the petition under section 13
(1) (i-a) of Hindu Marriage Act seeking to dissolve the marriage by the appellant has been dismissed.
2. Pursuant to the order dated 04/01/2018, respondent is personally present in Court with his counsel, Sri K. Ramesh Babu. This Court has interacted with the respondent and he submits that he has no objection if the present appeal is allowed, however, submits that he does not have any amount to pay the appellant herein.
3. The counsel for the appellant on instructions submits that if the marriage between the appellant and respondent dated 25/02/2011 is dissolved that would suffice the matter. The counsel for the appellant submits that the appellant is no more interested to get any maintenance or permanent alimony from the respondent.
4. Keeping in view the submissions made by the counsel for the appellant and respondent, we hereby dissolve the marriage
solemnized between the appellant and respondent on 25/02/2011. We hereby make it clear that since the counsel for the appellant has submitted before this Court on instructions that the appellant will not seek any permanent alimony or the maintenance amount, we hereby accept the plea and in view of the arguments advanced by the counsel for the appellant, we hereby allow the present appeal, in view of the reasons mentioned hereinabove. There shall be no order as to costs.
6. As a sequel, miscellaneous petitions if any, pending in this appeal shall stand closed.
