SMT JUSTICE T.RAJANI CRIMINAL PETITION No.24683 OF 2017 ORDER:

This Criminal Petition is filed seeking for grant of bail to the petitioner, who is accused, in Crime No.479 of 2017 on the file of the Station House Officer, S.N. Puram Police Station, Vijayawada City.

The offences alleged are under Sections 270 and 273 of Indian Penal Code and Section 8(c) R/w.20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the Act').

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

Learned counsel for the petitioner submits that the petitioner has been in jail since 18.08.2017, and he is the sole breadwinner of his family. 5.

As per the case of prosecution, the quantity seized from the petitioner is 50 K.Gs. of ganza, which is more than the commercial quantity. 6.

Learned Public Prosecutor brings to the notice of this Court that the earlier two bail applications filed by the petitioner were dismissed by considering the merits of the case.

In view of the above, this Court cannot grant bail to the petitioner as Section 37 of the Act comes in the way of granting bail to the petitioner. Hence, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
