O R D E R

Learned Government Pleader for Services - I, based on the averments made in the counter affidavit, submits that in compliance of the interim order of this court dated 23.10.2017 in WPMP.No.42498 of 2017 in W.P.No.34176 of 2017, respondent herein has submitted the action taken report to the Government in furtherance of G.O.Rt.No.135, Transport, roads and Building (Tr.Ser. & Vig.) Department dated 13.03.2015, pending disposal of writ petition and hence, there is no violation of the orders of this court. Copy of the said report is enclosed to the counter affidavit.

On the last occasion, as the counsel for the petitioner was not present, the matter was directed to be listed today under the caption of 'dismissal'. Today also there is no representation for the petitioner. In view of the averment made in the counter affidavit that action taken report has been submitted to the Government, I do not find any willful violation of the orders of this court and the contempt case is accordingly dismissed. If aggrieved, it is always open for the petitioner to challenge the said report in accordance with law.
