This Petition is filed under Section 482 of the Criminal Procedure Code, 1973 (Cr.P.C.), to quash the proceedings in C.C.No.464 of 2017 on the file of the Judicial First Class Magistrate at Bhainsa, registered for the offences punishable under Section 498-A of the Indian Penal Code, 1860 (IPC) and Sections 3 and 4 of the Dowry Prohibition Act, 1961, against the petitioner/accused No.1.

Heard learned Counsel for the petitioner and learned Public Prosecutor for respondent No.1- State.

In view of the order of this Court, dated 31.07.2017, in Crl.P.No.6493 of 2017, relying upon the latest two Judge Bench expression of the Apex Court, dated 27.07.2017, in Crl.A.No.1265 of 2017 (SLP (Crl.) No.2013 of 2017 in Rajesh Sharma & Others Vs. State of U.P. & another), this is a fit case to refer the matter to the Committee to be constituted for reconciliation and settlement and if not settled, then to proceed with the trial on merits.

Having regard to the above and as per the directions of the Apex Court, this Criminal Petition is disposed of by directing the

MSM,J Crl.P.No.24667 of 2017 Investigation Officer to proceed with the investigation, but not to arrest the petitioner unless a report of the Committee on its constitution is received. However, this order does not prevent respondent No.1- Police from securing the presence of the petitioner for interrogation as a part of their investigation. 6.
