Pattabhi Petitioner/Accused No.2 AND The State of Andhra Pradesh, rep. by the Public Prosecutor, High Court of Judicature at Hyderabad (Through the Station House Officer, P.S. Pakala, Chittoor District) Respondent/Respondent Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioner/Accused No.2 on bail in connection with Crime No. 87 of 2017 of P.S. Pakala, Chittoor District during the pendency of inquiry and trial. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri Suresh Kumar Reddy Kalava, Advocate for the Petitioner and of the Addl. Public Prosecutor (AP) for the Respondent, the Court made the following ORDER:
" This Criminal Petition is filed by the petitioner/A.2 under Section 439 of Cr.P.C. for grant of bail to him in Crime No.87 of 2017 of Pakala Police Station, Chittoor District, registered for the offences punishable under Sections 341, 323, 427, 506, 376(1) r/w 511 I.P.C. and Sections 11, 12 and 18 of the Protection of Children from Sexual Offences Act, 2012.

Heard the learned counsel for the petitioner/A.2, learned Additional Public Prosecutor representing the respondent-State and perused the record. 3.
The learned counsel for the petitioner/A.2 would submit that the petitioner/A.2 is an innocent person and falsely implicated in this case. The Investigation is completed and charge sheet is also filed, and prayed to allow the application.

The learned Additional Public Prosecutor opposed for grant of bail to the petitioner/A.2, contending that the petitioner/A.2 would threaten the witnesses. 5.
As seen from the record, charge sheet is filed in this case, Sessions Case No.50 of 2017 is given and the same is pending before the I Additional Sessions Judge (Special Judge), Chittoor. Since charge sheet is filed and as there is apprehension of threatening the witnesses, the petitioner/A.2 can be enlarged on bail under Section 439 Cr.P.C., on some conditions. 6.
Accordingly, the petitioner/A.2 is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties in a like sum each to the satisfaction of the learned I Additional Sessions Judge-cum-Special Judge for trial of cases under POCSO Act, Chittoor. On release, the petitioner/A.2 shall report before the Station House Officer, Pakala Police Station, Chittoor District, on every Sunday between 08.00 a.m. and 10.00 a.m., for a period of six (6) months from the date of this order. 7.
