THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No. 24556 OF 2017 ORDER:

This Criminal Petition is filed under Section 438 Cr.P.C. seeking to grant anticipatory bail to the petitioner-A.1 in crime No.972 of 2017 of Jawahar Nagar police station, Rachakonda, registered for the offences punishable under Sections 420 and 120B IPC.

Heard both sides and perused the material available on record.

The learned counsel for the petitioner-A.1 would submit that the petitioner-A.1 is innocent person and falsely implicated in this case; that he has nothing to do with the alleged forgery and registration of sale deeds, and ultimately, prayed to allow the application.

On the other hand, the learned Additional Public Prosecutor appearing for the respondent-State opposed the grant of bail to the petitioner-A.1 under Section 438 Cr.P.C. 5.

The material placed on record discloses that in this case, A.2 was remanded to judicial custody on 22.12.2017. In the course of investigation, it came to light that the petitioner-A.1 K.Srinivas Reddy, resident of J.P. Nagar, Moosapet, Hyderabad, introduced himself as brotherin-law of Mr.Ram Chandra Reddy, and he, along with other accused, told that they would arrange land for Rs.2,250/- square yard, and when A.2 asked them as to how they could arrange it at such a cheaper rate, A.1 informed that there was a small litigation in respect of said land and he would get it resolved, and so, the land is cheaper, and that he would manage the officials of Karnataka Bank, Somajiguda,

Hyderabad and facilitate to obtain loan from that Bank, and brought fraudulent registered sale deeds into existence without there being clear title to the property of the vendors. 6.

From the allegations, the element of cheating and dishonest intention coupled with fraudulent delivery of property can be inferred. There are specific allegations against the petitioner/A.1 of conspiring together and committing illegal acts. Under these circumstances, it cannot be said that the petitioner/A.1 is innocent person and falsely implicated in this case. The allegations are grave against the petitioner/A.1. The matter requires investigation. Release of the petitioner-A.1 on bail would hinder investigation. Under these circumstances, the petitioner-A.1 is not entitled for relief under Section 438 Cr.P.C. The Criminal Petition is devoid of merit and liable to be dismissed. 7.
