THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.44381 of 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking verbatim the following relief: "... to issue a writ or order more particularly one in the nature of writ of mandamus or an appropriate writ or order declaring the high handed and illegal action of the respondents 3-5 in attempting to demolish the petitioner's buildings bearing Door Nos.55 situated in an extent of 131 sq.yards on the main road, Tallur village and Mandal, Prakasam District, A.P without notice and without following due process of law contemplated under the Land Acquisition Act, is illegal, arbitrary, and unconstitutional and contrary to the principles of natural justice and pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."
At the hearing, learned counsel for the petitioner would submit that if a direction is given to the respondents not to interfere with in any manner or demolish the subject properties of the petitioners except by following the procedure established by law, the ends of justice would be met.
Learned Government Pleader appearing for the respondents 1 & 3 to 5, and learned Government Pleader appearing for the 2nd respondent endorses the said submissions.
Recording the afore-said submissions, the Writ Petition is disposed of directing the respondents not to interfere with in any manner or demolish the subject properties of the petitioner except by
following the procedure established by law. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
