HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 44498 of 2017 Order:
The petitioner, his wife and son are the absolute owners and possessors of the land of an extent of 600 sq. yards each, total 1800 sq. yards, situated in Survey No.514/3 of Chowdavaram village and Grampanchayat, Prathipadu Sub-Division, Guntur Mandal, Guntur District, having acquired the same under three separate registered sale deeds dated 30.07.1999. When the petitioner and his family members wanted to sell the land, the Sub-Registrar refused to register the same, as the said land was included in the list of prohibited properties prepared under Section 22-A of the Registration Act. In view of the same, the petitioner made a representation to the second respondent - District Collector for deletion of land in Survey No.514/3 from the prohibitory list and based on the application of the petitioner, a report was called for from the Tahsildar, Guntur Mandal and, accordingly, the Tahsildar, Guntur Mandal submitted his report to the second respondent on 07.04.2017. When no action was taken by the second respondent on the said report, the present Writ Petition is filed.
In view of the report submitted by the Tahsildar, Guntur Mandal on 07.04.2017 to the second respondent, the second respondent - District Collector shall pass appropriate orders in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
