THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 44479 of 2017 O R D E R :

The main grievance of the petitioner is that the notice dated 23.12.2017 under Section 452(2) of the Hyderabad Municipal Corporation Act, 1955 was issued without considering the explanation dated 15.12.2017 submitted by him pursuant to the notice dated 12.12.2017.

Today, learned Standing Counsel for the respondent Corporation, on instructions, fairly submits that the notice impugned in this Writ Petition may be set aside, so as to enable the Corporation to pass appropriate orders after considering the explanation submitted by the petitioner.

Considering the said submission, the notice dated 23.12.2017 is set aside with liberty to the respondents to take appropriate action in accordance with law, duly considering the explanation submitted by the petitioner on 15.12.2017. The Writ Petition is accordingly, allowed. No costs. Consequently, the miscellaneous Applications, if any shall stand disposed of.
