Shyam Rao Petitioner/Accused AND The State of Telangana, through SHO, Proh & Excise Station, Adilabad, Adilabad District, rep. by its Public Prosecutor, High Court of Judicature at Hyderabad. Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the Petitioner/Accused on bail who is in jail in connection with COR.No. 267 of 2017 of Proh & Excise Station, Adilabad, Adilabad District. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri S.Surender Reddy, Advocate for the Petitioner and of the Addl. Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:

" This Criminal Petition is filed by the petitioner/accused under Section 439 of Cr.P.C. for grant of bail to him in COR No.267 of 2017 of Prohibition & Excise Station, Adilabad, registered for the offence punishable under Section 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

Heard the learned counsel for the petitioner/accused, learned Additional Public Prosecutor representing the respondent-State and perused the record. 3.

As per the material placed on record, 1.250 Kgs. of dry ganja alleged to have been seized from the possession of the petitioner/accused under the cover of panchanama by following the procedure contemplated under law. The seized quantity is a small quantity. The truth or otherwise of the allegations are required to be established after due trial.

Under these circumstances, the petitioner/accused can be enlarged on bail under Section 439 Cr.P.C., on some conditions.

Accordingly, the petitioner/accused is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties in a like sum each to the satisfaction of the learned Judicial Magistrate of I Class, Adilabad. On release, the petitioner/accused shall report before the Station House Officer, Prohibition & Excise Station, Adilabad, on every Sunday between 08.00 a.m. to 10.00 a.m., till filing of the charge sheet. 5.
