THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.44434 of 2017 ORDER:
The petitioner herein applied for Teacher Eligibility Test (TET) examination conducted by the 2nd respondent in the month of May, 2016 and the said examination is qualifying exam for DSC. The respondent herein withheld the result of the petitioner in the said examination on the ground that 'Booklet Code Not Shaded' by the petitioner herein. According to the learned counsel for the petitioner withholding the result of the petitioner herein is contrary to order in W.P.No.26845 of 2017 and a copy of the same is also placed on record. While referring the above said order, it is submitted by the learned counsel for the petitioner that the petitioner herein is entitled for the same relief in the said writ petition. Counter affidavit is filed by the Director, State Council of Educational Research and Training, Hyderabad.
Paragraphs 8 and 9 of the counter affidavit read as under: "I further submit that the Ts-TET-2016 was held on 22-052016 and results were declared on 17.06.2016. As per the records issued by the Government in G.O.Ms.No.36 School Education (Training) Department, dated 23.12.2015 at point No.3. Creation of TET Cell "The maintenance of records like examination material, non-examination material shall be up to 6 months from the date of TET, except where legal cases are involved."
In view of the above, it is not possible to correct the OMR sheets without knowing the Booklet code and the key to which applied is not known."
The present Writ Petition came to be filed on 26.12.2017. According to clause 3 of G.O.Ms.No.36, dated 23.12.2015, the maintenance of records like examination material, non-examination material shall be up to 6 months from the date of TET, except where legal cases are involved. Examination in the said case admittedly
held on 22.05.2016 and writ petition came to be filed on 26.07.2017 as stated supra.
Therefore, having regard to the averments in the counter affidavit in paragraphs 8 and 9, no relief can be granted in the present writ petition in favour of the petitioner herein. Accordingly, Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
