THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.44646 of 2017 ORDER:

The petitioners state that their ancestors were in possession of agriculture lands situated in Survey No.57 (old Survey No.109/1) of Thunglam Village, Gajuwaka Mandal, Visakhapatnam District. The said lands were part of Estate lands of Vizianagaram Estate and their names were incorporated in the diglot register of Vizianagaram District. After abolition of Estates, ancestors were issued a rough patta bearing No.448, dated 03.09.1958 and since then they have been in possession of the said property. The names of the petitioners were recorded in the revenue records, pahanies and Adangals in respect of Survey Nos.109/1 to 109/12, but, they came to know that in the month of September, 2016, their names were deleted by the fourth respondent in the website and in those circumstances, they submitted a representation 18.10.

2016 requesting the 2nd respondent to incorporate their names in the webland, Adangal and pahani copies of the revenue records. Pursuant to the said representation, the second respondent issued proceedings on 21.10.2016 directing the fourth respondent to examine the matter and take necessary action as per rules and intimate the same to the petitioners with a copy marked to his office. In spite of the same, when no action was taken, the present Writ Petition is filed.

Even after issuing Notice before admission, there is no response from the fourth respondent and no counter-affidavit is filed. 3.

It is clear from the above facts and the proceedings of the District Collector, dated 21.10.2016, the District Collector directed the Tahsildar to take appropriate action on the representation of the

petitioners by examining the records, but, no action was taken even after one year. In the circumstances, appropriate disciplinary action shall be taken against the fourth respondent for his negligence in obeying the orders of the superior authority. Independent of the said disciplinary proceedings, the fourth respondent is directed to examine the request of the petitioners, as indicated in the proceedings of the District Collector, dated 21.10.2016, and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________________ A.RAMALINGESWARA RAO, J FEBRUARY 07, 2018 YVL
