This writ petition is filed challenging the seizure dated 14-12-2017 seizing the stocks of Petrol and Diesel belonging to the petitioner on the ground of variations. Learned counsel for the petitioner says that except variations, there is no other allegation against the petitioner and said variation of the stock is also within the permissible limits, as such the seizure itself is illegal. He also submits that though the petitioner has made representation on 23-12-2017 to the 2nd respondent for release of the stocks, no orders are passed on the same. He further submits that licence issued to the petitioner under the provisions of A.P.Petroleum Products (Licensing and Regulation of Supplies) Order, 1980 is still subsisting. He further submits that on 16-12-2017 the officials of Bharath Petroleum Corporation Limited visited the retail outlet of the petitioner and found that variation of the stock is within permissible limits.

Heard learned Government Pleader Civil Supplies. Prima facie, it appears that variation of the stock is within the permissible limits. In view of the same, the 2nd respondent is directed to consider the representation stated to have been filed by the petitioner for release of the stocks enabling the petitioner to carry on the business. The said exercise shall be done within a period of one week from the date of receipt of a copy of this order. However, the release of

stocks shall be subject to order to be passed in the enquiry under Section 6-A of the Essential Commodities Act. With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 27-12-2017 Note:
