HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.44594 OF 2017 ORDER:

This writ petition is filed with the following prayer: ...."to issue a writ, order or direction more particularly one in the nature of a Writ of Mandamus declaring the action of the 4th and 5th respondents in not granting/renewing licence of petitioner's firm bearing License No.517/2010-2015, as commission agent insisting the conditions with respect to security deposits be fulfilled as laid down in G.O.Ms.No.57, Agricultural and Co-Operation (AM-II) Department, dated 12-102015, violating the Rule 50(2) of A.P.( Produce and Livestock) Market Rules, 1969 is illegal, arbitrary and against the principle of natural justice and also violating Article 14 of Constitution of India and to pass such other order or orders as may deem fit and proper in the interest of justice."

It is stated by learned counsel for the petitioner that the list in the writ petition is squarely covered by order passed by this Court in WP.No.39682 of 2017, dated 23-11-2017. The same is not disputed by learned Standing Counsel for respondent No.5.

In view of the same, for the reasons alike, this writ petition is also allowed directing the respondents 4 and 5 to consider the petitioner's application for grant of commission agent's licence and pass appropriate orders without reference to G.O.Ms.No.57, Agriculture and Cooperation (AM-II) Department, dated 12-10-2015, but, by applying the norms in G.O.Ms.No.190, Agriculture and Cooperation (MKTG.I)

Department, dated 06-04-1994, and communicate the decision to the petitioner within two weeks from the date of receipt of a copy of this order. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
