HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.7457 of 2017 ORDER :

Heard both sides. Perused the grounds of revision and the impugned order of the lower Court.

In fact, there is nothing to interfere with the impugned order of the lower Court, but for to say in permitting withdrawal of the amount to be deposited, the plaintiff/respondent to the appeal shall furnish security to make good in the event of success in the appeal by the appellant/defendant, time is granted till 28.02.2018 to deposit, failing which, the stay ceases automatically to entitle the decreeholder/plaintiff to execute the trial Court's decree, which is not a bar from pendency of appeal.

Accordingly and in the result, the civil revision petition is disposed of.

Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
