Mekapati Nagarjuna, S/o. Subbaiah (A4) Petitioner (Accused No.4 in Cr.No.206/2013 of Chilakaluripeta Town P.S., Guntur District) AND The State of Andhra Pradesh, rep by its Public Prosecutor at High Court of Andhra Pradesh, Hyderabad, & SHO, Chilakaluripeta Urban Police Station, Guntur District. Respondent Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to direct the respondents ie., SHO, Chilakaluripeta Urban Police Station, to release the petitioner on bail in the event of his arrest pertaining to Crime No. 206 of 2013. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri K.L.N.Swamy, Advocate for the Petitioner and of the Addl. Public Prosecutor (AP) for the Respondent, the Court made the following ORDER:
" This Criminal Petition is filed by the petitioner/A-4 under section 438 Cr.P.C., seeking grant of anticipatory bail to the petitioner, who is A-4 in Crime No. 206 of 2013 of Chilakaluripeta Police Station, Guntur district, registered for the offences punishable under section 309, 306 of I.P.C.
2. Heard the learned counsel for the petitioner/A-4 and the learned Additional Public Prosecutor appearing on behalf of the respondent/State.
3. The counsel for the petitioner/A-4 submits that A-2 was already enlarged on bail and that this petitioner/A-4 also stands on the same footing.
4. Considering the above fact, this Criminal Petition is allowed and the petitioner/A-4 is directed to be enlarged on bail in the event of his arrest in Crime No. 206 of 2013 of Chilakaluripeta Town Police Station, Guntur district on his executing a personal bond for Rs.20,000/- [Rs. Twenty Thousand only] with two sureties for the like sum each to the satisfaction of Station House Officer, Chilakaluripeta Town Police Station, Guntur district.
5. Further, on such release, the petitioner/A-4 shall abide by the conditions enunciated under Section 438 (2) Cr.P.C., which are as hereunder: i) The petitioner/A-4 shall make himself available for interrogation by a Police Officer as and when required ; ii) The petitioner/A-4 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the Court or to any Police Officer ; and iii) The petitioner/A-4 shall not leave India without the previous permission of the Court.
6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed."
