VIJAYA LAKSHMI COUNSEL FOR THE RESPONDENT : THE PUBLIC PROSECUTOR (TG) Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to grant regular bail to the petitioners in Crime No.573 of 2017 on the file of II Additional Judicial First Class Magistrate at Mancherial, Adilabad District on such terms and conditions as this Hon'ble Court deems fit and proper to enlarge the petitioners/Accused Nos. 1 to 3 on bail till final disposal of the case.

The Court made the following Order:

This Criminal Petition is filed under Section 439 Cr.P.C. seeking to grant bail to the petitioners-A.1 to A.3 in crime No.573 of 2017 of Mancherial police station registered for the offences punishable under Sections 498A, 304-B, 354 read with 34, 302 read with 109 IPC and 3 and 4 of the Dowry Prohibition Act, 1961.

Heard both sides and perused the record.

As per the material placed on record, the deceased Kasireddy Vidyulatha was given in marriage to petitioner-A.1 on 08.08.2012. It is alleged that at the time of marriage, an amount of Rs.15.00 lakhs and other household articles were given as dowry, and an amount of Rs.1.00 lakh was given towards adabidda katnam. Thereafter, it was alleged that the deceased was physically and mentally harassed by the petitioners-A.1 to A.3. There is also specific allegation against A.2 that he attempted to sexually assault the deceased.

As seen from the record, the petitioners-A.1 to A.3 were remanded to judicial custody on 19.11.2017. Material witnesses are examined. Most part of the investigation is completed. There is nothing to detain further the petitioners-A.1 to A.3 in the judicial custody. The allegations are required to be proved against them as per the procedure established under law. Therefore, they can be enlarged on bail on some conditions.

In the result, the petitioners-A.1 to A.3 shall be enlarged on bail each of them executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each for the like sum to the satisfaction of the II Additional Judicial Magistrate of First Class, Mancherial. The petitioners-A.1 to A.3 shall report before the said S.H.O. on every Sunday between 10.00 AM and 11.00 AM till filing of charge sheet in the case. 6.
