THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.44643 OF 2017 ORDER:

The petitioner prays for the following relief: ".......Writ of mandamus declaring the action of the respondents in not registering FIR, as arbitrary, illegal......"

The Assistant Government Pleader, on instructions, received from 4th respondent, submits that the allegations in the complaint made by petitioner deal with civil dispute and therefore, General Diary entry has been made. However, keeping in view the mandate of Lalitha Kumari vs. State of Uttar Pradesh1 case, FIR is not registered.

It is stated by the Assistant Government Pleader that the petitioner would be sent written communication on the outcome of General Diary entry, within four (04) weeks from the date of receipt of copy of this order.

The statement is placed on record.

Writ petition is accordingly, disposed of. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
