THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY Contempt Case No.2822 of 2017 ORDER:

This Contempt Case is filed alleging violation of orders dated 30.11.2017 passed by this Court in W.P.No.40427 of 2017. By the above said order this Court has directed respondent Nos.2 and 3 in the writ petition to stop all constructions, proposed constructions and developmental activities in the subject property until three weeks from the date of receipt of a copy of the order.

During the pendency of the contempt case, respondent No.2 has filed counter affidavit stating in para 2 of the counter affidavit that respondent No.5 in the writ petition has taken up the work on his own and the official respondents have not erected any poles and have not strung the electric lines. Since the construction of laying of the poles has been taken up by respondent No.5 in private land respondents herein are not having any authority to remove the same. As such there is no willful or deliberate violation of the orders passed by this Court. In these circumstances, this Contempt Case is closed as no further orders are necessary. However, liberty is granted to the petitioner, if any cause survives, to file fresh application seeking revival of the contempt case in accordance with law.

Miscellaneous petitions, if any pending in this contempt case shall stand closed.
