HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.44669 OF 2017 O R D E R :

This writ petition is filed challenging the show-cause notice dated 20.12.2017 in Rc.No.1346/2017, wherein the petitioner was asked to show cause as to why his fair price shop authorisation should not be cancelled for the irregularities committed by him.

Learned counsel for the petitioner submits that though petitioner submitted explanation to the impugned show cause notice, without passing any orders on the same, the respondents stopped supplying essential commodities to the petitioner's fair price shop for distribution. Learned Government Pleader for Civil Supplies submits that the writ petition is premature and the impugned notice is only a show cause notice issued framing charges and that the authorities will pass necessary orders, since it is stated that the petitioner filed explanation.

In view of the same, the writ petition is disposed of directing the respondents to pass orders after considering the explanation of the petitioner and after affording opportunity of hearing to the petitioner. Till passing of orders, the respondents are directed to supply stocks to the petitioner as long as his authorisation is valid and subsisting.

Accordingly, the writ petition is disposed of. No order as to costs.
