HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.44565 of 2017 ORDER:

This writ petition is filed challenging the action of respondents 2 and 4 in including the land of the petitioners to an extent of Ac.1-00 cents in sy.No.632/A1, Sy.No.604/1B2 and sy.No.605/1A of Kollabylu Village, Madanapalle Mandal, Chittoor District in the prohibitory list under Annexure-II as Assigned. It is stated by learned counsel for the petitioners that in similar circumstances, this Court has allowed WP.No.44039 of 2017, dated 08-11-2018. The same is not disputed by learned Assistant Government Pleader for Revenue.

In view of the same, for the reasons alike in WP.No.44039 of 2017, dated 08-11-2018, this writ petition is also allowed with a direction to the respondents to delete the land of the petitioners from the list of prohibitory lands under Annexure-II issued under Section 22-A of the Registration Act, (for short "the Act") forthwith; it is open for the petitioners to present the document for registration in respect of the subject property before the 5th respondent and on submission of the said document, the 5th respondent shall register the same without reference to the prohibitory list under Section 22-A of the Act. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
