THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.44599 of 2017 When the matter is taken up, written instructions, dated 27.12.2017, furnished by the Station House Officer, Kalapathar Police Station, are placed on record by the learned Government Pleader. The said written instructions read as under: "It is submitted that on 24.07.2017 one Praveen Sultana/the petitioner lodged complaint with the respondent police against one MD Jameeluddin 4th respondent herein stating that her property which was situated at Bilal Nagar Kalapathar house bearing No.19-2-2-34/27 728 was occupied by her brother Md.Jameeluddin and his family members, when she went to their house to see them, elder son of his sister behaving criminally and frightened to her by using filthy language.
Basing on the same a case in Cr.No.104/2017 registered for the offences U/Sec.506, 509 and took up the investigation. During the course of investigation the respondent police visited the scene of offences and prepared draft sketch. 6 witnesses were examined and recorded their statements.
It is further submitted that the investigation is completed and accused was arrested and released on bail.
The investigation is completed and charge sheet was filed before the Special Judicial 1st Class Magistrate on 10.07.2017 vide CC.No.207/2017 on 10.08.2017.
It is further submitted that on 13.04.2017 the petitioner lodged same complaint with the respondent police, after receiving the same the police made GD entry vide SL.No.U 2023088173900277 as the matter is civil in nature, later the police registered a case against the accused".
A request is made by the learned counsel for the petitioner to place the said written instructions on record and dispose of the Writ Petition.
Accordingly, the Writ Petition is disposed of, by placing on record the above written instructions.
As a sequel thereto, miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ________________ A.V.SESHA SAI 24th January, 2018.
