Petition filed under Sections 438 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to grant anticipatory bail in Crime NO. 398 of 2017, Muvvalavanipalem Police Station and to release the Petitioners/Accused Nos. 1 to 5 in the event of their arrest in the interest of justice.

The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri S.V.S.S. Siva Ram, Advocate for the Petitioners and of Addl. Public Prosecutor(AP) on behalf of Respondent-State, the Court made the following ORDER :- "The Criminal Petition is filed by the petitioners under section 438 Cr.P.C., seeking grant of anticipatory bail to the petitioners, who are A-1, A-2, A-3, A-4 and A-5 in Crime No. 398 of 2017 of Muvvalavanipalem Police Station, Visakhapatnam district, registered for the offences punishable under section 427, 384, 506, 509, 323 and with section 34 of IPC and section 3 [1] [s] and 3 [2] [va] of Scheduled Castes and Scheduled Tribes [Prevention of Atrocities] Act, 1989.

2. Heard the learned counsel for the petitioners/A-1 to A-5 and the learned Additional Public Prosecutor appearing on behalf of the respondent/State.

3. The allegations made in the complaint, no doubt, would constitute an offence under section 3 [1] [s] and 3 [2] [va] of Scheduled Castes and Scheduled Tribes [Prevention of Atrocities] Act, 1989. But the counsel for the petitioners draws attention of this Court to the complaint lodged by the second petitioner/A-2 herein, on the same day of the complaint lodged by the defacto-complainant in this case, wherein it was mentioned that the defactocomplainant and others have threatened these petitioners that they will file a case stating that these petitioners have abused the defacto-complainant and insulted by touching in their caste name.

4. Hence, in the light of the above facts, this Court is of the opinion that prima facie, the allegations made in the complaint may not be true. Contd.2....

In view of the above, this Criminal Petition is allowed and the petitioners/A-1 to A-5 are directed to be released on bail in the event of their arrest in Crime No. 398 of 2017 of Muvvalavanipalem Police Station, Visakhapatnam district on each of them executing a personal bond for Rs.20,000/- [Rs. Twenty Thousand only] with two sureties for the like sum each to the satisfaction of Station House Officer, Muvvalavanipalem Police Station, Visakhapatnam district. However, the petitioners/A-1 to A-5 shall appear before the Station House Officer, Muvvalavanipalem Police Station, Visakhapatnam district, as and when called for the purpose of investigation.

6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed."
