This Writ Petition is filed seeking writ of mandamus declaring the action of the respondent No.3 in not initiating action against 5th respondent for cancellation of the permit BA No.26/2016, dated 31.03.2016 granted in his favour for making construction in Sy.Nos.527 & 531 in Kothacheruvu Grampanchayat & Mandal, Anantapur District pursuant to representation dated 03.10.2017 and report of the 6th respondent dated 08.08.2017, as illegal and arbitrary.

Heard learned counsel for the petitioner and Sri G.Seshadri, learned Standing Counsel for 3rd respondent.

Admittedly, petitioner has alternate remedy of appeal under Section 128 of Panchayat Raj Act, 1994 (for short 'the Act of 1994') in respect of the relief claimed by him in writ petition. In view of the same, this Court is not inclined to entertain the Writ Petition. Accordingly, this Writ petition is disposed of granting liberty to the petitioner to avail alternate remedy of appeal under Section 128 of the Act of 1994. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
