THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.44969 of 2017 ORDER:
The petitioner prays for the following relief: ".......Writ of Mandamus declaring the action of the 2nd respondent in not taking up the suit and not passing any orders on the interlocutory application or on the suit filed by the petitioner against the 3rd respondent even though the suit papers were received on 23.11.2017, as illegal, arbitrary......"
In view of the prayer sought for, there shall be a direction to 2nd respondent to dispose of interlocutory application filed along with O.S. (un-numbered) dated 23.11.2017 within one (1) week from the date of receipt of copy of this order.
Petitioner is given liberty to file a memo by enclosing a copy of this order along with copy of un-numbered O.S. and interlocutory application.
Writ petition is accordingly, disposed of. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
