HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.44941 OF 2017 ORDER:

This Writ Petition is filed seeking writ of mandamus declaring the action of the respondent No.3 restraining the petitioner to construct at D.No.23-3/3, Ward No.7, Block No.23, Narasannapeta Village, Srikakulam District as illegal and arbitrary and consequently to sanction the approval of the plan submitted along with the application dated 17.07.2015.

It is the case of the petitioner that he made an application for permission to construct building on 17.07.2015 and he also paid requisite fee. Though legal notice was issued on 16.02.2017, still no orders are passed for granting of building permission. After issuing the aforesaid legal notice, petitioner proceeded with the construction under deemed provision, but the respondents are trying to interfere with the construction activity of the petitioner. The petitioner also made representation to the 2nd respondent on 15.03.2017, but no action is being taken. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and Sri Ravi Cheemalapati, learned Standing Counsel for the 3rd respondent. Since the grievance of the petitioner is already pending before the 2nd respondent, the 2nd respondent is directed to consider the representation of the petitioner dated 15.03.2017 and the 3rd respondent is also directed to consider the representation of the petitioner dated 17.07.2015 take appropriate action within a period of one week from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
