HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.44856 of 2017 ORDER:

The petitioner aggrieved by the ejectment order, dated 21.09.2017 passed by the 3rd respondent filed appeal before the 2nd respondent on 01.12.2017.

Now the grievance of petitioner is that neither the stay application nor the appeal is taken up for hearing. Hence, the writ petition.

Heard Mr.M.M.M.Srinivasa Rao for petitioner and the Assistant Government Pleader for Tribal Welfare.

The right of appeal is valuable statutory remedy and the 2nd respondent, after examining the prima facie case, balance of convenience etc., by now, ought to have passed an order in the stay petition filed by the petitioner.

The Assistant Government Pleader submits that instead of directing the 2nd respondent to dispose of the stay application, the appeal filed on 01.12.2017 can be directed to be disposed of expeditiously.

The statement is placed on record.

Having regard to the above circumstances, the ejectment order of 3rd respondent, dated 21.09.2017, is stayed pending disposal of appeal by 2nd respondent. The appeal is directed to be

heard and disposed of, as expeditiously as possible, preferably within four months from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No order as to costs.
