AND The State of Telangana, Through SHO., P.S., Lingapur, Kumrambheem Asifabad District, rep by its Public Prosecutor, High Court of Judicature at Hyderabad Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioners/Accused Nos 4 & 5 on bail who are in Jail in connection with Cr. No. 23 of 2017 of P.S. Lingapur, Kumrambheem, Asifabad District on such terms and conditions. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri S. Surender Reddy, Advocate for the Petitioners and of the Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:

This Criminal Petition is filed under Section 439 Cr.P.C. seeking to grant bail to the petitioners-A.4 and A.5 in crime No.23 of 2017 of Lingapur police station registered for the offences punishable under Sections 120B, 420, 366, 344, 506 IPC and 3 (1) (r) and 3 (1) (s) of the SCs & STs (PoA) Act. 2.

Heard both sides and perused the record.

As per the material placed on record, the petitioners-A.4 and A.5 were remanded to judicial custody on 31.10.2017. It appears from the record that material witnesses are examined. There is nothing to detain further the petitioners-A.4 and A.5 in judicial custody. The allegations are required to be proved against them as per the procedure established under law. Having regard to the nature of allegations and the material collected so far, the petitioners/A.4 and A.5 can be enlarged on bail on some conditions.

In the result, the petitioners-A.4 and A.5 shall be enlarged on bail each of them executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each for the like sum to the satisfaction of the Judicial Magistrate of First Class, Utnoor. The petitioners-A.4 and A.5 shall report before the said S.H.O. on every Sunday between 10.00 AM and 11.00 AM till filing of charge sheet in the case.
