THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.44829 of 2017 ORDER:

This Writ Petition is filed seeking verbatim the following relief: ".....to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in attempting to demolish the respective shop of the petitioners bearing Door No.5/122, 5/121 and 5/123 & 5/124, Korrapadu Road, Proddatur, YSR District without following the procedure laid down under the Right to Fair compensation, Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 as illegal, unjust, arbitrary, high handed, mala fide, against Art.300A of the Constitution of India and consequently direct the respondents not to demolish the petitioners' respective shop Nos. 5/122, 5/121 and 5/123 & 5/124, Korrapadu Road, Proddatur, YSR District without following due process of law and pass such other order or orders as this Hon'ble High Court may deem fit and proper in the circumstances of the case."

2) When the matter is taken up for hearing, learned counsel for the petitioners submits that the matter is squarely covered by the judgment of this Court in Chamala Venkata Syamala @ Geetha and another v. The State of Andhra Pradesh and 3 others1, which fact has not been disputed by the learned Standing Counsel for the 2nd respondent. 3) In those circumstances, recording the submission made by the learned counsel for the petitioner, without expressing any opinion, the Writ Petition is disposed of in terms of the judgment of this Court in Chamala Venkata Syamala case (1 supra). Office to tag a copy of the order passed in W.P.No.41217 of 2017 to this Writ Petition. There shall be no order as to costs.

4) Consequently, Miscellaneous Petitions pending, if any, in this Writ Petition, shall stand closed.
