HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.45100 OF 2017 O R D E R :

This writ petition is filed challenging the inaction of the 3rd respondent in completing the enquiry pursuant to the show cause notice dated 27.09.2017 and the proceedings in Rc.No.4619/2017-B, dated 27.09.2017, where under petitioner's authorisation was suspended.

Learned counsel for the petitioner submits that without passing final orders, petitioner's authorisation was kept under suspension though petitioner submitted explanation on 12.10.2017 in pursuance to the show cause notice. Heard learned Assistant Government Pleader for Civil Supplies.

This court in D.Sambasiva Rao v. Joint Collector, Guntur and others (2007 (6) ALT 239 has taken a view that suspension of fair price shop authorization pending enquiry, cannot normally be continued beyond a period of ninety days. In view of the same, the impugned order in RC No.4619/2017-B, dated 27.09.2017, issued by the 3rd respondent suspending the petitioner's authorization, is set aside. However, this order will not preclude the respondent authorities from passing final orders.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 02.01.2018 t k.
