THE HON'BLE DR.JUSTICE SHAMEEM AKTHER TRANSFER CRIMINAL PETITION NO.284 OF 2017 ORDER:

This petition is filed by the petitioners-accused under Section 407 Cr.P.C. to transfer C.C.No.6 of 2017 on the file of the Principal Session Court, Eluru, West Godavari District to the Court of Metropolitan Sessions Judge, Vijayawada, Krishna District.

Heard both sides and perused the record.

The contention put forth by the learned counsel for the petitioners is that by virtue of order of this Court, dated 11.03.2014, in W.P.No.31381 of 2013, similar cases were transferred to Metropolitan Sessions Judge, Vijayawada, Krishna District and the same are pending. 4.

The allegations levelled against the petitioners in the instant case are similar to those cases. Therefore, this case is required to be decided by the same Court, which is dealing with the earlier transferred cases.

Under these circumstances, C.C.No.6 of 2017 on the file of the Principal Session Court, Eluru, West Godavari District is withdrawn and transferred to the Court of Metropolitan Sessions Judge, Vijayawada, Krishna District for trial and disposal in accordance with law. 6.

Accordingly, the Transfer Criminal Petition is allowed. Miscellaneous petitions, if any pending in this Petition shall stand closed.
