This Writ Petition is filed seeking writ of mandamus declaring the action of the respondents 2 to 5 in not taking action against the respondents 6 and 7 for encroaching into road and road margin and making illegal constructions in Sy.No.307/1 of R.Kothapalli Village, Bethamcherla Mandal, Kurnool District, as illegal and arbitrary and consequently to direct the respondents 2 to 5 to initiate necessary action against them by considering the representations dated 27.11.2017, 04.12.2017 and 11.12.2017. Heard learned counsel for the petitioner and Sri G.Seshadri, learned Standing Counsel for 5th respondent.

The grievance of the petitioner is that the unofficial respondents encroached upon the public road in Sy.No.307/1 of R.Kothapalli Village, Bethemcherla Mandal, Kurnool District and that against the same, petitioners have made representations on 27.11.2017, 04.12.2017 and 11.12.2017 to the respondents, but no action is being taken. Aggrieved by the same, present writ petition is filed.

Sri G.Seshadri, learned Standing Counsel for 5th respondent submits that the petitioners have not made any representations to the 5th respondent-Grampanchayat.

Learned counsel for the petitioner submits that the petitioner will make fresh application before the 5th respondent.

In view of the same, this Writ Petition is disposed of granting liberty to the petitioner to make representation to the 5th respondent and on such representation, the 5th respondent is directed to consider the same and take action in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
