THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.24689 OF 2017 ORDER:

This petition is filed under Section 439 Cr.P.C. to grant bail to the petitioners-A3, A6 and A7 for the offence alleged under Section 8 (c ) r/w 20 (b)( ii) (c) of NDPS Act, 1985.

Heard learned counsel for the petitioners, learned Additional Public Prosecutor representing the State and perused the record.

In the course of submissions, it has come to light that 50 Kgs of ganja, which is a commercial quantity was seized from the possession of the petitioners under a cover of panchanama. There is a stringent punishment for the offence alleged under 8 (c) r/w 20 (b)( ii) (c) of NDPS Act, 1985. So, it is not desirable to grant bail to the petitioners as there is possibility of repeating the similar offence in future and as such, it cannot be held that the petitioners are innocent persons. However, a direction can be given to the trial Court to dispose of the case as expeditiously as possible.

Under these circumstances, the trial Court is directed to dispose of the NDPS Sessions Case (Cr.No.32 of 2017 of Chintoor Police Station, East Godavari District) within a period of four months from the date of this order. 5.

With the above direction, the Criminal Petition is dismissed.
