HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.44903 of 2017 Order:

In spite of issuing notice before admission on 04.01.2018 and granting further time on 08.02.2018, learned Government Pleader did not get any instructions. In the circumstances, this Court is constrained to dispose of the present Writ Petition based on the averments made in the affidavit filed in support of the Writ Petition. The petitioner owns an extent of 231.60 sq. yards in Plot No.47 of Survey Nos.41/7, 41/8, 41/9 and 41/10, situated at Khanamet village, Sherilingampally Mandal, Ranga Reddy District. He claims to have purchased the same under a registered sale deed dated 01.10.1995. He further states that he submitted a representation for conducting survey of the land and paid requisite challan also on 22.06.2017. When no action was taken by the second respondent, the present Writ Petition is filed.

It is the case of the petitioner that the second respondent is deliberately not conducting the survey in spite of his application and the learned Government Pleader, on the other hand, submits that the land claimed by the petitioner is only a plot of land and as per the circular instructions issued by the Commissioner of Land Administration the plots of land cannot be surveyed.

This Court is not going into the merits of the case, but since the petitioner submitted an application way back on 22.06.2017 it is incumbent upon the second respondent to consider the application and pass appropriate orders in accordance with law. In view of the same, this Writ Petition is disposed of directing the second respondent to consider the application of the petitioner dated

22.06.2017 and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs. ________________________ A.
