SMT JUSTICE T.RAJANI CRIMINAL PETITION No.24714 OF 2017 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.2, in Crime No.285 of 2017 on the file of Aize Police Station, Jogulamba District. The offences alleged are under Sections 420 and 468 R/w.34 of I.P.C.

Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the respondent-State and perused the record. 3.
As per the case of prosecution, through the confession of accused No.1, this petitioner sell the empty passbook and accused No.1 purchased the same from this petitioner and manipulated the passbook and issued the same to the de-facto complainant.

Learned Public Prosecutor submits that the petitioner is not supposed to print the passbook and sell the same and, hence, the petitioner/accused No.2 can be considered as participes crimines. Learned counsel for the petitioner also does not refute the fact that the petitioner is not supposed to print the passbook and sell the same.

Hence, in view of the above, this Court considers that this is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner/accused No.2 is directed to surrender the before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application expeditiously, preferably on the same day, subject to pressure of other work. Accordingly, with the above observation, this Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
