THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.45127 of 2017 ORDER:

The petitioner states that she is a graduate in B.Sc (B.ZC). Her husband expired. She had two children and she is the sole breadwinner in the family. When a notification was issued by the first respondent offering posts on contract basis, she was selected as semi skilled work person and she was deputed by the second respondent - contractor. She states that she faced sexual harassment at work place and she brought it to the notice of the respondents. She lodged a complaint in the Rajendra Nagar Police Station and it was registered as Crime No.1681 of 2017 on 10.08.2017 under Section 354D IPC. When she attended to duty on 11.08.2017 she was stopped by her supervisor and she is not being allowed to continue her duties. In those circumstances, she filed the present Writ Petition. It is clear from the above averments that the petitioner was a contractual employee deputed by the second respondent. Though she has been working with the first respondent, there is no relationship of an employer and employee between the first respondent and the petitioner.

In the circumstances, the present Writ Petition is not maintainable in this Court. The Writ Petition is, accordingly, dismissed. However, this will not prevent the petitioner from availing the alternative remedies available to her under law.

The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 02.01.2018 vs
