THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.45097 of 2017 ORDER :

This Writ Petition is filed challenging the inaction of the respondent authorities in taking steps to get the petitioner's lands in Sy.Nos.72 E, 73E, 74E, 73A1/1,85/AA, 472 AA, 507E, 508E, 29AA, 36A admeasuring Ac.5.10 Gts. Ac.5.11 Gts, Ac.2.07 Gts, Ac.1.24 Gts., Ac. 0.09 Gts., Ac.4.05 Gts., Ac.2.37Gts., Ac.5.38Grs, Ac.1.05 Gts., and Ac. 1.27 Gts. respectively situated at Paleru and Nelapatla village, Kusumanchi Mandal, Khammam District in spite of the written representations dated 08.11.2017 and 01.12.2017. 2.

A perusal of the representation shows that the petitioner's father left those lands in Khammam District prior to 1994. In the meanwhile, some third parties occupied those lands. The petitioner also disclosed that they are not aware of the total extent of land hold by their Predecessors.

In those circumstances, appropriate remedy for recovery of lands from the encroachers is before the Civil Court and respondents cannot make the roving enquiry in respect of the lands alleged to have been owned by the petitioners and decide the rights of the parties . In view of the same, this Court is not inclined to entertain the present writ petition.

The Writ Petition is accordingly dismissed. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
