THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No. 24727 OF 2017 ORDER:

This Criminal Petition is filed under Section 438 Cr.P.C. seeking to grant anticipatory bail to the petitioner-A.2 in crime No.466 of 2017 of Raidurgam police station, Cyberabad registered for the offences punishable under Sections 370, 370A (ii) IPC and 3, 4, 5, 6 and 7 of the Immoral Traffic (Prevention) Act, 1956.

Heard both sides and perused the material available on record.

The learned counsel for the petitioner-A.2 would submit that the petitioner-A.2 is innocent person and falsely implicated in this case; that the petitioner resigned as an employee of A.1-firm and she has nothing to do with the allegations. It is further contended on behalf of the petitioner-A.2 that entire investigation is completed and as per the record, there is no role of the petitioner-A.2 in the alleged offences; that the principal offender was granted regular bail; that the petitioner-A.2 has a small 3 years old child, and ultimately, prayed to allow the application. 4.

On the other hand, the learned Additional Public Prosecutor appearing for the respondent-State opposed the grant of bail to the petitioner-A.2 under Section 438 Cr.P.C. 5.

The material placed on record discloses that A.1 to A.5 were running SPA (massage centre) under the name and style 'Tantra SPA' at plot Nos.21 and 22, Trendz Dwaraka Building, Telecomnagar, Gachibowli, Hyderabad by procuring women from various places and doing activities of immoral trafficking by providing opposite sex massages to customers

and earning wrongful gain. It is further alleged that the accused were detaining the women for prostitution keeping their belongings like passports, etc. The raiding party also caught red-handed some customers and women/SPA workers while they were doing illegal trafficking activities. It is also alleged that the management of the SPA was not maintaining transparent doors to massage rooms and proper illumination in the rooms. The raiding party also seized certain incriminating material from the SPA.

There are specific and grave allegations against the petitioner-A.2 relating to human trafficking. She was employed in the SPA(massage centre) at the relevant point of time. There are also allegations against the petitioner-A.2 that she was procuring women from various places under the guise of massage centre and made unlawful earnings. There are allegations of detaining innocent women for the above purpose. The details of the victims are given in the FIR. It is also alleged that passports of the victims were detained. Further more, when police raided on 19.08.2017, some incriminating material relating to sexual acts were found in the subject massage centre. Therefore, it is difficult to sustain that the petitioner resigned from the A.1 firm and has nothing to do with the alleged offences.

The allegations are grave and specific against the petitioner-A.2. The matter requires investigation. Release of the petitioner-A.2 on bail would hinder investigation. Under these circumstances, the petitioner-A.2 is not entitled for relief under Section 438 Cr.P.C. The Criminal Petition is devoid of merit and liable to be dismissed.
