HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.44988 OF 2017 O R D E R :

This writ petition is filed challenging the inaction of the 3rd respondent in completing the enquiry pursuant to the proceedings dated 30.08.2017, where under petitioner's authorisation was suspended for shop No.6, Dubbanakallu Village, Adoni Mandal, Kurnool District, for indefinite period. Learned counsel for the petitioner submits that in the impugned suspension order charges are framed in respect of 'Jowar', which is the agricultural produce of the petitioner; and that though petitioner submitted explanation on 16.08.2017 in pursuance to the show cause notice, no orders are passed till date.

Heard learned Assistant Government Pleader for Civil Supplies.

This court in D.Sambasiva Rao v. Joint Collector, Guntur and others (2007 (6) ALT 239 has taken a view that suspension of fair price shop authorization pending enquiry, cannot be normally continued beyond a period of ninety days. In view of the same, the impugned order vide RC.M.2385 of 2017, dated 30.08.2017, issued by the 3rd

respondent suspending the petitioner's authorization, is set aside. However, this order will not preclude the respondent authorities from passing final orders.

Accordingly, the writ petition is allowed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 02.01.2018 t k.
