HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 45156 of 2017 Order:
The petitioner is working as Motor Vehicle Inspector. While so, he was placed under suspension, by proceedings dated 16.08.2016, on the ground that he was negligent in discharging his duties and a regular departmental enquiry was contemplated. The present Writ Petition is filed challenging the said order of suspension.
Learned counsel for the petitioner submits that the departmental proceedings did not commence and no subsistence allowance is also being paid to the petitioner even after lapse of one year. This Court carefully perused the order of suspension and since the departmental proceedings were contemplated, this Court is not inclined to entertain the present Writ Petition, but the law is well settled with regard to payment of subsistence allowance and the respondents are directed to pay the subsistence allowance to the petitioner during the period of suspension. Since the charge levelled against the petitioner relates to discharge of his duties relating to the period from 2013 to 2017 and more than one year has elapsed, the respondents are directed to complete the enquiry and pass final orders thereon by giving due opportunity to the petitioner within a period of six (6) months from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
