THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 45200 of 2017 O R D E R:

This writ petition is filed by the petitioner on mere apprehension that respondent Nos.2 to 5 may release the compensation amount in favour of respondent Nos.6 and 7. The petitioner asserts that on 04.08.2017, he submitted representations enclosing a copy of the legal heir certificate to the District Collector, Bhadradri Kothagudem, the Revenue Divisional Officer, Bhadrachalam and the Land Acquisition Officer and Special Deputy Collector, Land Acquisition, Palvancha. Till today, he has not received any communication.

Learned Government Pleader for Revenue, on instructions, submits that the efforts made by the respondent authorities to contact the petitioner did not fructify, and as on date, no award is passed. He also submits that the petitioner may approach the Land Acquisition Officer and present his case. Admittedly, as of date, the award proceedings have not been concluded. In view of the same and considering the submission of the Learned Government Pleader, this Court deems it appropriate to permit the petitioner to appear before the Land Acquisition Officer on 12.02.2018 at 10.30 a.m. and the

Land Acquisition Officer shall take into consideration the case of the petitioner before passing award.

The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:01.02.2018 Note: Issue cc today.
