SMT JUSTICE T.RAJANI CRIMINAL PETITON No.24765 OF 2017 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A8, in C.C.No.67 of 2013 on the file of Judicial First Class Magistrate, Sathyavedu, Chittoor District. The offences alleged are under Sections 20(1)(c)(ii), (iii), (iv) and (x) and 20(1)(d)(i) of A.P.Forest Act, 1967 and contravention of Rules 3 of A.P.Red Sanders and Sandal Wood Transit Rules, punishable under Section 29(4)(a)(i) of the said Act, Destruction of Habit of Wild Life in Reserve Forest contravention of Section 29 of Wild Life (Protection) Act, 1972 punishable under Section 51(1) of the said Act and Sections 378(a) and 379 of IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution, the petitioner was involved in transport of red sanders illegally. The public prosecutor submits that this petitioner has been absconding since long and that inspite of NBW being issued and inpite of there being an order by this court for him to surrender before the court below, he is not complying with the said order. 4.

Hence, in view of the above, this court opines that this is not a fit case for granting anticipatory bail.

Accordingly, the Criminal Petition is dismissed.

However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 29.01.2018 SS
